United States First Circuit

US v. GRACE, 03-1087

A defendant does not have to make an FRCP rule 29 motion in a bench trial to preserve the usual standard of review for a sufficiency of the evidence claim on appeal. District court supportably found that defendant's possession of a firearm to protect her drugs and proceeds of drug sales satisfied the nexus requirement in 18 U.S.C. section 924(c).
