GEN. HEALTHCARE LTD. v. QASHAT, 03-1968
The transportation of goods bearing the "Kent Creme Bleach" trademark from a manufacturer in the US to its offices in the UK is not "use in commerce" sufficient to confer ownership rights in the mark. As plaintiff had no US rights to the trademark, summary judgment for defendants is affirmed.
