PENA-BORRERO v. ESTREMEDA, 03-1084

Plaintiff, arrested on a second occasion under the same warrant, raises allegations that would support a jury conclusion that officers acted unreasonably in arresting and incarcerating him; dismissal is vacated. Not only did the officers fail to check on the warrant beforehand, they followed through on it even when confronted with proof that it was no longer effective.
