COZZA v. NETWORK ASSOCS., INC., 03-1578

Denial of defendant's Motion for Reconsideration of Motion to Compel Arbitration is affirmed. Even assuming that defendant's motion can be construed as a renewed motion to compel arbitration based on new evidence, and that appellate jurisdiction would exist over the denial of such a motion, new evidence supporting arbitration was not shown to have emerged in plaintiff's deposition.
