DOUGLAS v. YORK COUNTY, 03-2086

Summary judgment was improperly granted to defendants on civil rights claims brought by a woman who was allegedly raped while incarcerated over 30 years earlier. To the extent there was an ambiguity in her expert affidavit, it had to be construed in her favor, as the non-moving party; denial of her motion for reconsideration was an abuse of discretion.
