CANDELARIO-RAMOS v. BAXTER HEALTHCARE CORP. OF PUERTO RICO, INC., 03-1774

Summary judgment was properly granted to defendant-employer on allegations that the different treatment given to early retirees under its Domestic and Puerto Rico pension plans violates Title VII. There was no evidence that defendant acted out of animus to Puerto Ricans, thus the discriminatory treatment claim fails.
