United States First Circuit

US v. COLON OSORIO, 02-2722

The denial as "untimely" of defendant's motion for funds to secure an explosives expert was close to, if not beyond, the limits of the court's discretion; since uncontradicted evidence compels the conclusion that the device in question was an explosive, however, any error was harmless. His convictions are affirmed.
