United States First Circuit

REPPERT v. MARVIN LUMBER & CEDAR CO., INC., 03-2234

Plaintiffs' suit, alleging damages by reason of defective windows manufactured by defendant, was properly dismissed on res judicata grounds, given the preclusive effects of a settlement and judgment entered in a prior, Minnesota class action. Under Minnesota law, res judicata principles apply as to every matter which might have been litigated.
