United States First Circuit

STEWART v. TUPPERWARE CORP., 03-1404

In determining the amount-in-controversy, a federal district court should not be constrained by the amounts awarded by the Supreme Court of Puerto Rico. It is not a legal certainty that plaintiffs' claims, concerning physical injuries sustained and mental anguish suffered as a result of a car crash, involve less than $75,000.
