FOISY v. ROYAL MACCABEES LIFE INS. CO., 03-1382

Under the terms of her annuity policy from defendant, plaintiff was entitled to lifetime payments, not merely to five years of payments. The statute of limitations did not begin to run on her contract and negligent misrepresentation claims until payments stopped in 1999; defendant was not entitled to judgment as a matter of law on either claim.
