Defendant has no cognizable grounds for appealing the district court's ruling that he is personally liable on a defaulted promissory note. Once he had constructive notice that the district court might elect to convert plaintiff's FRCP rule 12(c) motion and decide it as one for summary judgment, he had to show, by competent evidence, that a trialworthy issue existed.
