RODRIGUEZ-GARCIA v. MUNICIPALITY OF CAGUAS, 03-1493

Plaintiff's federal claims are saved because of Puerto Rico's rule permitting tolling where a prior judicial action has been filed. Since the causes of action in her state and federal complaints were based on the same substantive claim and sought the same forms of relief, the claims are identical for purposes of 31 Puerto Rico Laws Ann. section 5303.
