O'BRIEN v. TOWN OF AGAWAM, 03-1685

In an action alleging that a town's compensation scheme for police officers violates the FLSA by omitting certain wage augments from the calculation of the officers' overtime rate, arbitration was not required under the CBA, and summary judgment as to the officers covered by the FLSA is reversed.
