US v. VIGNEAU, 02-1119

Convictions on multiple federal charges for participation in a drug distribution scheme are affirmed over claims that 1) there was an error in sentencing which resulted in an additional 38 months incarceration, 2) sentence exceeded the statutory maximum in violation of Apprendi v. New Jersey, 530 U.S. 466 (2000), and 3) district court erred in denying defendant's motion for a new trial based on newly discovered evidence.
