A state public utilities commission never made a "determination," for purposes of section 252(e)(6) of the Telecommunications Act of 1996, thus no subject matter jurisdiction existed. 42 U.S.C. section 1983 claims for damages against commissioners in their individual capacities were barred by "quasi-judicial" immunity.
