US v. CORTES-CLAUDIO, 01-2113

After guilty pleas to drug conspiracy charges, 21 U.S.C. section 841(b) controlled, and conferred authority upon the district court to impose a ten-year term of supervised release, but such a term amounted to an upward departure requiring prior notice and a statement on the record as to the aggravating circumstances warranting such a departure.
