United States First Circuit
PAN AM. GRAIN MFG. CO., INC. v. PUERTO RICO PORTS AUTH., 99-2024
In an action for damages to a docked vessel, 1) court's finding, that the vessel grounded in marked shallow water, was not clearly erroneous, 2) wharfinger duties were not breached where no obstructions in the berthing area were found, and 3) sanctions were proper based on a pattern of bad faith in connection with the discovery of evidence.
