US v. MOORE, 01-2307

In determining whether prior drug convictions may serve as predicate offenses for sentence-enhancement purposes under the Armed Career Criminal Act (ACCA), because the state statute under which defendant was previously convicted provides for a maximum possible penalty of ten years' incarceration, convictions fit within the definition of "serious drug offense" as defined in the ACCA, and sentence affirmed.
