RICHARDSON v. MILLER, 01-1309
In a civil rights action seeking:(1) the return of items taken from the plaintiff during a police search; and (2) an injunction preventing the government from using the materials in any criminal investigation of plaintiff, where the government returned some but kept many of the seized materials for its investigation of the plaintiff, plaintiff was not the "prevailing party" for purposes of an award of attorney-s fees under the Attorney's Fee Awards Act of 1976, 42 U.S.C. - 1988.
