STATE OF MAINE v. DIR., US FISH & WILDLIFE SERV., 01-1770

Simply because earlier litigation forced the government to take a certain position does not mean that the government will inadequately represent the position, mandating intervention under Fed. R. Civ. P. 24(a)(2), but should the government representation prove to be inadequate, the district court should reconsider the proposed intervenor's request to intervene.
