UNDERWRITERS AT LLOYD'S v. LABARCA, 00-2142

Where the risk to a ship is readily capable of being resolved at all times by a simple expedient, the shipowner's warranty of seaworthiness remained in effect and because her unseaworthy condition was the cause of the sinking, the insurer had no obligation under the insurance policy.
