GARDNER v. VESPIA, 00-1544

Because the Second Amendment does not confer an absolute right to bear arms, plaintiff's inability to purchase a gun because of a misinterpretation of his conviction status does not implicate a constitutional right, so defendant is entitled to qualified immunity.
