United States First Circuit

US v. BURGOS, 99-1465

Under the co-conspirator exception to hearsay exception, defendant was not deprived of a fair trial by the allowance of prejudicial statements purportedly made by co-conspirators, despite the fact that no independent evidence, other than the statements themselves, showed by a preponderance of the evidence that a conspiracy existed between the declarant and the defendant.
