United States Eleventh Circuit

US v. Rothenberg, 08-17106

Defendant's sentence for sexual exploitation of a minor and possession of child pornography is affirmed where there was no clear error in the district court's finding that defendant's chats crossed the line between sexual banter and criminal persuasion, inducement or enticement, and that he engaged in a pattern of activity involving prohibited sexual conduct justifying application of the enhancements provided for in U.S.S.G. sections 2G 2.2(b)(5) and 4B 1.5(b)(1).
