In a 42 U.S.C. section 1983 First Amendment retaliation claim by a terminated law enforcement officer, dismissal of the complaint is affirmed in part where the right to run for office was not clearly established at the time of the complaint. However, the order is reversed in part where the district court erred in applying a heightened pleading standard to plaintiff's First Amendment claim.
