United States Eleventh Circuit
Sacred Heart Health Sys., Inc. v. Humana Military Healthcare Servs., Inc., 08-16430
In a class action by hospitals claiming that defendant-HMO systematically underpaid them for medical services they rendered to veterans under a federal program, and thereby breached their individual network provider agreements, the district court's order certifying a class is reversed where many important uncommon questions raised in the litigation overwhelmed the one common issue -- whether the federal government forced defendant to pay the hospitals lower rates -- and rendered the case unsuitable for class treatment.
