Friends of the Everglades v. S. Fla. Water Mgmt. Dist., 07-13829
In an action seeking to compel a water district to obtain a permit to discharge pollutants into a lake, judgment for Plaintiffs is reversed, where the EPA's NPDES Water Transfers Rule, which reasonably construed the Clean Water Act (CWA), stated that a transfer of a pollutant from one navigable body of water to another is not a "discharge of a pollutant" under the CWA.
