In an action challenging the Fish & Wildlife Service's (FWS) approval of an endangered species protection plan, summary judgment for Defendant is affirmed in part and reversed in part where: 1) FWS's biological opinion considered all material facts; but 2) FWS's "take statement" contained no trigger for re-consultation.
