Chalfonte Condo. Apt. Ass'n. v. QBE Ins. Corp., 08-10009

In an action seeking a declaratory judgment of insurance coverage, the Court of Appeals certified the following questions to the Florida Supreme Court: 1) whether Florida law recognizes a claim for breach of the implied warranty of good faith and fair dealing against an insurer for failure to investigate a claim within a reasonable period of time; 2) whether Florida law recognizes a private right of action under Fla. Stat. section 627.701(4)(a) and whether an insurer's failure to comply with Section 627.701(4)(a) renders a hurricane deductible unenforceable; and 3) whether an insurer contractually waives its right to stay execution of a judgment against it by posting a supersedeas bond.
