United States Eleventh Circuit

US v. Vazquez, 0810671

Sentence of 180 months' imprisonment for conspiracy with intent to distribute cocaine is affirmed where: 1) the district court did not procedurally err when it declined to mitigate defendant's sentence due to its concern over the application of the career offender provision; and 2) since the district court imposed a below-range sentence, it clearly understood its discretion to apply the Sentencing Guidelines in an advisory manner.
