United States Eleventh Circuit

Nguyen v. US, 0712874

In a false arrest action brought by an immigrant physician, grant of defendant-government's motion to dismiss on sovereign immunity grounds is reversed where the doctor's claims against the U.S. for false arrest, false imprisonment, and malicious prosecution arising from the acts or omissions of federal investigative or law enforcement officers were expressly permitted by the plain language of the proviso to Federal Tort Claims Act, 28 U.S.C. section 2680(h). (Substituted opinion)
