Belanger v. The Salvation Army, 0810330

In a case of first impression regarding a diversity action against defendant-The Salvation Army to recover funds which defendant obtained from a pay-on-deathbed bank account established in the name of decedent's trust, grant of motion to dismiss in favor of defendant is affirmed where the plain language of section 655.82 permitted a corporation to be beneficiary of a pay-on-death account because the definition of the term "person" in section 1.01(3) of the state statute included corporations.
