In an appeal concerning whether a state statute, Ga. Code Ann. section 33-24-7(b) allows an insurer to rescind a life insurance policy because the deceased insured misrepresented his net worth and annual income in his application for the policy, summary judgment in favor of plaintiff-insurer is affirmed and cross-appeal filed by plaintiff is dismissed where the district court: 1) did not abuse its discretion when it admitted and excluded experts' testimony; and 2) correctly ruled that plaintiff-insurer was entitled to rescind decedent's policy under subsection 33-24-7(b)(2).
