United States Eleventh Circuit

US v. Bennett, 0812352

In a per curiam decision, conviction for possession of a firearm by a convicted felon is affirmed where: 1) because the law enforcement agent had a reasonable belief that the occupants of one of the bedrooms could be dangerous and his reason for moving them to the bed was legitimate, his sweep of occupants' grab areas was properly limited; 2) the under-mattress search was not unlawful; 3) because the agents' conduct was not unlawful, defendant's challenged statements were not the fruit of unlawful conduct; and 4) the weapon and statements were properly admitted to evidence.
