Werner Enters., Inc. v. Westwind Maritime Int'l, Inc., 07-15488

In an action to recover the full value of a shipment of lost cell phones under the Carmack Amendment to the Interstate Commerce Act, summary judgment for common carrier sustaining a limitation of its liability is affirmed where, contrary to insurer's claims: 1) this case is not distinguishable from Norfolk Southern Railway Co. v. Kirby, 543 U.S. 14, 125 S. Ct. 385, 160 L.Ed.2d 283 (2004); 2) the contractual limitation of liability at issue complied with the applicable statutory requirements; and 3) the district court did not apply an incorrect rate of prejudgment interest.
