In claims under the the Alien Tort Statute and the Torture Victim Protection Act of 1991 alleging that defendant-subsidiary of state coal mine company paid paramilitary operatives to torture and assassinate leaders of plaintiff-Colombian trade union, grant of partial summary judgment in favor of defendant is affirmed where: 1) the district court had subject matter jurisdiction; 2) the district court did not commit any reversible error in its other rulings; and 3) the district court did not abuse its discretion in denying the plaintiffs' requests about their late-disclosed witnesses.
