United States Eleventh Circuit
H.A.L. v. Foltz, 0715791
In a per curiam decision on a claim filed by plaintiff-minor children against defendant-employees of Florida Department of Children and Families for violation of their Fourteenth Amendment substantive due process rights to physical safety and to be free from unreasonable harm, denial of defendants' motion to dismiss based on qualified immunity is affirmed where defendants knowingly subjected children to substantial risk of harm and exhibited deliberate indifference to the known risk.
