United States Eleventh Circuit

Blankenship v. Hall, 0810511

In conviction and sentence for burglary, rape, and felony murder, denial petition for writ of habeas corpus is affirmed where: 1) petitioner failed to overcome the "strong presumption" that his counsel's performance at the 1986 resentencing was reasonable; 2) petitioner did not prove counsel was unaware of his life history and did not make a reasonable, strategic choice to pursue residual doubt; and 3) the state court did not unreasonably apply Strickland v. Washington in finding petitioner's counsel were not ineffective at the final resentencing trial.
