Butler v. Alabama Dept. of Transportation, 07-13358
In former employee's action claiming defendant-agency discriminated against her on the basis of race, had retaliated against for reporting another employee's use of racial epithets, and had constructively discharged her, judgment in favor of plaintiff is reversed and case is remanded for entry of judgment in favor of defendants where plaintiff's testimony did not demonstrate that a similarly situated employee outside of her protected class was treated differently.
