Gulf Fishermen's Ass'n v. Gutierrez, 07-12903

In an action challenging a fishery management plan, dismissal of plaintiff's complaint as time-barred under the Magnuson-Stevens Fishery Conservation and Management Act is reversed and remanded where a suit filed within 30 days after the Federal Register published a Secretarial action was considered timely filed under the judicial review provisions of the underlying Act.
