US v. Campa, 03-11087
In a prosecution of several agents of the Cuban Directorate of Intelligence for murder charges and espionage against the United States military and Cuban exiles in southern Florida, their convictions are affirmed over claims regarding: 1) suppression of evidence from searches conducted under the Foreign Intelligence Surveillance Act; 2) sovereign immunity; 3) discovery of information under the Classified Information Procedures Act; 3) trial issues on exercise of peremptory challenges, alleged prosecutorial and witness misconduct, and jury instructions; and 4) the sufficiency of the evidence. The case is remanded for partial resentencing of some defendants where the court erred in applying U.S.S.G. section 2M3.1(a)(1) instead of section 2M3.1(a)(2) in the absence of a finding that top secret information was gathered or transmitted.
