United States Eleventh Circuit

Crawford v. Carroll, 07-11603

In a Title VII suit brought by an African-American employee alleging claims of retaliation and race discrimination by her Caucasian supervisors and her state university employer, summary judgment for defendants is affirmed in part and reversed in part where: 1) the existence of genuine issues of material fact precluded summary judgment on plaintiff's Title VII retaliation and race discrimination claims against her employer, as well as 42 U.S.C. section 1983 race discrimination claims against one of her supervisors; but 2) because plaintiff failed to produce evidence sufficient for a reasonable jury to conclude one of her supervisor's adverse decisions were motivated by racial bias, that supervisor was entitled to qualified immunity on racial discrimination claims against her.
