Belize Telecom, LTD v. Government of Belize, 06-12158

In an action primarily involving a dispute over the proper interpretation of two Articles of Incorporation provisions governing the appointment and removal of a corporation's directors, the district court's judgment, partially contrary to a Belizean court's prior interpretation, is reversed in part and remanded where: 1) abstention factors of international comity, fairness to litigants, and efficient use of judicial resources all weighed in favor of deference to the Belizean court's decision; and 2) the district court abused its discretion in failing to apply the proper analysis and refusing to defer to the Belizean judgment.
