In an action filed under the Boren Amendment for defendants' failure to adequately reimburse intermediate care facilities for the developmentally disabled, dismissal of the lawsuit as moot is affirmed where: 1) the basis of the lawsuit, the Boren Amendment, had been repealed; and 2) defendants complied with Boren's successor statute before the district court entered final judgment on plaintiffs' Boren claim.
