In Re: Hedrick, 07-11179

In a bankruptcy proceeding wherein the doctrine of equitable subrogation was invoked concerning a transfer of security deeds in the debtors' properties, grant of summary judgment for creditors is affirmed where, considering all the circumstances, the underlying transaction constituted a "substantially contemporaneous exchange" under 11 U.S.C. section 547(c)(1) which the trustee could not avoid.
