US v. Svete, 05-13809

Defendants' conviction and sentence for multiple offenses including conspiracy, mail fraud, mail laundering, and interstate transportation of money obtained in fraud, are vacated in part and reversed in part where the current Eleventh Circuit pattern jury instruction for mail fraud, which omits the requirement of ordinary prudence by investors, seriously impaired defendants' ability to conduct their defense on the substantive counts of mail fraud.
