In a case arising from a child custody battle pitting a mother from the Netherlands against an American father, dismissal of complaint challenging state court's ne exeat order forbidding mother from removing the child from its jurisdiction pending its decision is affirmed as the state court's ne exeat order does not constitute a "retention" within the meaning of the Hague Convention.
