In a civil rights complaint alleging due process violations when plaintiffs' housing subsidy was terminated for the presence of an unauthorized resident, summary judgment for defendants is reversed where the Hearing Officer erred in this case in relying upon legally insufficient evidence to terminate plaintiff's Section 8 assistance.
