Busby v. JRHBW Realty, Inc., 06-15308
Denial of certification to a class of plaintiffs seeking damages arising out of defendant's alleged violation of Section 8(b) of the Real Estate Settlement Procedures Act is reversed where: 1) the proposed class satisfies Federal Rule of Civil Procedure 23(b)(3); 2) class issues predominate; and 3) a class action is the superior method for dealing with the claims raised. The district court applied the wrong legal standard in finding this RESPA section 8(b) case analogous to Yield Spread Premium cases brought under RESPA section 8(a).
