Rodriguez v. Secretery for the Dep't of Corr., 05-14600

In prisoner civil rights action alleging prison officials violated his rights, summary judgment for one defendant, and judgment for the other defendant, are vacated as: 1) genuine issues of material fact remain regarding whether one defendant was subjectively aware that plaintiff faced a substantial risk of serious harm; 2) evidence exists in the record from which a reasonable juror could find a causal connection between defendants' actions and the Eighth Amendment violation; and 3) a reasonable juror could find that the other defendant was subjectively aware that plaintiff faced a substantial risk of serious harm.
